Market Consulting Corporation (MCC) undertakes work upon receipt of a modest retainer for initial review of documents and materials related to a case together with discussions with the client. For the benefit of both the client and MCC, we work on an evergreen retainer system in the belief that the work should develop “without surprises.”
MCC will discuss the case with the client. In MCC’s experience, the client and MCC will then be able to divide the work to be done into logical phases. Each phase of the projected work will be discussed with the client in advance. Payment of MCC’s fee for the phase is requested by wire before work on each phase begins. This procedure is intended to protect the client against unexpected bills resulting from larger than anticipated expenditures of time, and to expedite initiation of the work.
In the case (unusual in MCC’s experience) that unanticipated work is presented or problems are encountered within a phase that could lead to expenditures exceeding the retainer amounts, the client will be notified of the then-current circumstances and provided with information concerning any additional retainer sums needed.
MCC work in our offices is billed at regular rates based on 7-hour days. We have found that out-of-office preparation days with clients can be very long, often running well into the evening. For this reason, days out-of-office are usually billed at a flat rate regardless of time spent. Testimony, while often relatively brief, requires presence and engagement well beyond the actual time spent testifying.
We do not charge for travel time unless we work in transit, and then charges are limited to actual hours spent. Clients are requested to prepay transportation and lodging expenses.
